just a little question regarding the competition.(i didnt totally understand)
does this:

"West End Records reserves the right to use your performance, appearance, name, voice, singing voice, likeness and any musical sound effects produced by you or any persons assisting in the production and writing of your submission, in connection with any television programs, motion pictures, or the internet for all purposes, including advertising, marketing, promotion, merchandising and the exploitation of any and all ancillary and subsidiary rights.; as same be edited, in all media, throughout the universe, in perpetuity for no compensation, unless other required by law. "

...mean that ALL SUBMISSIONS can be exploited for commercial purposes? or only the top 10 who are licenced by you?
if i send you a cd, can you use it without licencing it from me?

More importantly, say I submit something, and it doesn't make the final top 10, West End doesn't hold any rights to that song after the contest is over correct ?

I can take that song and shop it without any issues with West End correct ?

Also, does the track have to be a work not already registered to a publisher ?

Say I have my label and my publishing company set up, I have a song I want to submit, but its already registered under my publishing company, is it not eligible ?

To Jordache:

The clause below refers to something different. During the voting process, we will be video taping the panel of judges listening to the submission and deciding on their top 10. During that time, your submission may be played and heard. That clause allows us to legally air your submission. Other than that, we will not manufacture as a release unless a Master License or Master Purchase Agreement is signed by you.

If you make it to the top 10, you will be asked to sign a NON-EXCLUSIVE LICENSE agreement. That allows us to feature your submission, at our discretion (see contest rules for the "advance" agreement pertaining to the top 10).

If you are chosen as the winner of the contest, an agreement will need to be signed to allow West End Publishing affiliates to share in the publishing copyright(i.e., if you're already registered with your own publishing company). RE: the top 10, publishing issues are not applicable since it is a license agreement.
