All nine -- including three adults and six juveniles -- admitted to having sex with the girl, but during sentencing, Judge Sarah Bradley concluded:
"All of you have pleaded guilty to having sex with a 10-year-old girl and (one of the juveniles) has pleaded guilty to having sex with another young girl as well. All of you have to understand that you cannot have sex with a girl under 16. If you do, you are breaking the law, and if you are found out, then you will be brought to court and could end up in jail. I accept that the girl involved, with respect to all of these matters, was not forced, and that she probably agreed to have sex with all of you."
I repeat: The judge said the 10-year-old "probably agreed to have sex with all of you." The nine males received a finger-wagging, suspended sentences and probation. Word of the sentencing, or lack thereof, was reported yesterday in the Australian and sparked outrage. It turns out, most of Australian (http://dir.salon.com/topics/australia/) society is of the mind that a 10-year-old cannot possibly consent to sex and already there are calls for Judge Bradley to step down.
As our e-mail tipster pointed out, the judgment is widely seen as an example of the "shameful neglect" of Australia's indigenous population. The victim is aboriginal and lived in the indigenous community of Aurukun. After being sexually abused and contracting syphilis at age 7, she was shuttled from foster home to foster home, eventually settling with a non-indigenous family. But, as an unnamed senior official in the Department of Child Safety told the newspaper, after nine months, social workers concluded that it was wrong to put "an indigenous child with white foster parents."
She was returned to Aurukun, where she was raped by the nine males in 2006 and contracted gonorrhea. What's more, a senior Child Safety officer knew that the girl had gonorrhea, according to the Australian, yet did not report it to police, as is required by law. Why? She said she was busy looking into the possibility of nonsexual transmission of gonorrhea.

I visited Australia a few times while I was stationed in Japan, and even though I DID get a few ignorant individuals my way, everybody else were pretty nice, especially the Aboriginals...
But considering all the drama going down there lately (race riots in Sydney,2005(?)), I doubt that I'll be visiting there again.

Mr. Conrad with all due respect SIR! But its NOT just 1 case its a systematic. Australia has a ‘white Australia’ policy in immigration, reflecting an Anglo white attitude in their approach to other races particulary the Aboriginal people.
Australia has also had a very racist past in which apartheid has been practiced and where indigenous Aboriginal people have lost almost all their land and suffered many prejudices.
Also that MOFO John Howard, (right wing) Prime Minister refusing to say ‘sorry’ to the Aboriginal people, for past wrongs.
The rioting in Sydney has reflected an ongoing build up of tension between the 2.

MELFORT - The alleged victim in a sexual assault trial wailed loudly and covered her face when the Crown prosecutor on Tuesday presented her clothes from the night three men allegedly attacked her.
"I don't want to look," the girl cried, burying her face in her hands.
She sobbed and sniffled throughout her testimony and was nearly inaudible at times, her voice being washed out by the whir of ceiling fans. Justice Ellen Gunn repeatedly asked the girl to speak clearly for the jury.
On several occasions, Crown prosecutor Robin Ritter had to repeat his questions and implore the girl to respond, as she often sat for minutes in silence.
"It's important you tell us what happened. I have to ask the questions," Ritter said.
"I can't talk about it anymore. I don't like speaking in front of a lot of people," said the girl, who cannot be identified.
She eventually identified a pair of jeans and socks as the ones she wore on Sept. 30, 2001, when she was 12 years old and a runaway from Porcupine Plain.
Jeffrey Chad Kindrat, now 26, is on trial at Melfort Court of Queen's Bench charged with sexually assaulting the girl, now 17. He and two other men are alleged to have picked her up in the small town of Chelan and plied her with several beers before pulling to the side of grid road and taking turns having sex with her.
Asked Tuesday by Ritter if she wanted to have intercourse, the girl said no, but she was "too scared to say anything" to make them stop.
In a videotaped statement made by the RCMP at the time of Kindrat's arrest and played Monday for the jury, Kindrat says the girl asked for "more, more" after the other two men were done. He says he pulled his pants down, but didn't have sex because he "couldn't get it up."
The jury was told Tuesday that a sex assault kit, with vagina swabs, was performed on the girl at the hospital. An unspecified item of her clothing was also tested and Kindrat's DNA was not present in any of the samples.
A co-accused, Jeffrey Lorne Brown, now 30, is scheduled for trial in October. The third man, Trevor Dean Edmondson, now 29, was convicted in May 2003 and given a sentence of two years of house arrest rather than jail. The Crown had sought at least four years of prison time.
Kindrat and Brown were originally tried and acquitted together in June 2003, but the Crown appealed a month later and the Court of Appeal ordered new trials. Edmondson has served his time.
The verdicts outraged advocacy groups and the First Nations community because the girl is aboriginal. The accused men are white, as was the jury at Brown and Kindrat's first trial.
A jury of nine women and three men, again all white, was chosen on Monday for Kindrat's retrial. It is set for two weeks, but arguments will likely wrap up today as most witnesses have been heard.

"Any right person would have questioned why I was running away and tried to take me back home," she said.
Dr. Eleanor McKenna, a Saskatoon expert in child abuse who examined the girl on Oct. 2, 2001, testified on Tuesday afternoon that the girl looked older. The girl also told court she was able to get into the bar in the village of Mistatim with the three men.
While they were driving around, the men offered her beer several times but she refused until one of them said, "It'll take away your problems," she testified. She drank fast, unaware what effect it would have.
The girl said she became so drunk she threw up and blacked out at various times. She remembers someone trying to pull down her pants inside the truck, while she struggled to pull them up again. The next thing she remembers is being outside the truck with her pants off and "two of the guys were holding me and the other one was having intercourse with me. It hurt so bad," she said.
After the assault, she was driven to a house in Tisdale, where her friend Jesse Pierce lived. On Tuesday, Pierce, who is now 19, described the girl as "wasted" on alcohol to the point of slurring and unable to walk on her own. She told the family, "I was being raped. I've been raped," Pierce testified.
His dad, Gary Pierce, drove the girl to the Tisdale hospital. Gary testified she was grabbing at her crotch and "screaming and moaning in pain all the way."
Within hours, the RCMP were taking a statement from her and had Brown, Kindrat and Edmondson in custody.
During cross-examination, defence lawyer Morris Bodnar noted many contradictions in the girl's story on Tuesday compared to a 2002 preliminary hearing and police statement taken at the hospital immediately after the incident. At the preliminary hearing, she was asked if she could remember anything Kindrat did and she said no. She also said in 2002 that none of the men were mean or rough with her. On Tuesday, she claimed she was yelled at and received scrapes and bruises.
McKenna examined the girl at the request of a family physician in Tisdale. She detected several "very small" lacerations and abrasions on the girl's body, including a "superficial" tear to vaginal tissue.
All of the injuries appeared to be relatively recent, McKenna said, estimating the scrapes at 36 to 48 hours old and the torn tissue to have occurred within three days. Responding to questions from Bodnar, McKenna said the tissue tear is common during sex, whether consensual or not, and not at all painful.

Hey all i would just like to add my two cents worth - alot has changed down here since my father's generation migrated here and was openly abused for being different. Australia DID have a white policy (in the 50's!) but now has a strong policy of multi culturalism and all people are encouraged to activley participate in their culture and this brings alot of diversity to our society, as opposed to some other countries where people of different backgrounds are encouraged to assimilate in society and forget their culture.
Like every country we have our share of ignorant idiots leading to events such as the Cronulla Riots in 05 where racism was displayed by all rioting groups.
Also, please don't use John Howard as an example of Australians especially since the majority of the country strongly disagreed with him on the 'Sorry' issue.
I'm sorry if my ranting is incoherent but I just wanted to get these thoughts off my chest! We have a great reputation of being welcoming and friendly and a big part of Aussie culture is about 'giving everyone a fair go'. It's a beautiful country and I would hate to think that some over priveligded old farts with no grip on reality are making it look bad!

Hey all i would just like to add my two cents worth - alot has changed down here since my father's generation migrated here and was openly abused for being different. Australia DID have a white policy (in the 50's!) but now has a strong policy of multi culturalism and all people are encouraged to activley participate in their culture and this brings alot of diversity to our society, as opposed to some other countries where people of different backgrounds are encouraged to assimilate in society and forget their culture.

Australia DID have a white policy (in the 50's!) but now has a strong policy of multi culturalism and all people are encouraged to activley participate in their culture and this brings alot of diversity to our society, as opposed to some other countries where people of different backgrounds are encouraged to assimilate in society and forget their culture.
Like every country we have our share of ignorant idiots leading to events such as the Cronulla Riots in 05 where racism was displayed by all rioting groups.
Also, please don't use John Howard as an example of Australians especially since the majority of the country strongly disagreed with him on the 'Sorry' issue.
I'm sorry if my ranting is incoherent but I just wanted to get these thoughts off my chest! We have a great reputation of being welcoming and friendly and a big part of Aussie culture is about 'giving everyone a fair go'. It's a beautiful country and I would hate to think that some over priveligded old farts with no grip on reality are making it look bad!
I still think we ALL have a long way to go as far as racial equality is concerned...
