OKLAHOMA CITY (Reuters) -- An Oklahoma man arrested on suspicion of beating his wife faced year in prison and a fine. But when he spit in an arresting officer's face, he got a life sentence instead, officials said Wednesday.

John Carl Marquez, 36, was convicted of "placing bodily fluid upon a government employee," a felony that can carry a life sentence because of the possibility of transmitting a potentially deadly disease.

State judge April Sellers White sentenced Marquez this week even though Marquez and the officer tested negative for any communicable disease.

Marquez also was convicted of assaulting a police officer, and a jury recommended the maximum sentence because he had previous convictions.

Marquez, arrested several months ago, could have received one year in prison and a $3,000 fine for wife beating, according to the Creek County court clerk's office.

His lawyers said they plan to appeal.

undoubtedly that sentence will get reduced, but, ol boy could have received the death penalty, immediately, for spitting in a cops face

WTF??? As much as I hate life-criminals, this sentence is ridiculous. And what's with only serving one stupid year for beating up someone? He would have done 5 months at the most and he would have been out to beat his wife for sending him there. Isn't our government great? graemlins/jpshakehead.gif

A Texas prisoner who threw his faeces over a prison officer has been given an additional 50 years in prison for harassment.

Bobby Ferguson, 37, was convicted of harassing officer John Pope, following the incident in January 2002.

Ferguson had apparently become angry after being moved to another cell in Huntsville without his belongings.

Prosecutor Kelly T Weeks said Ferguson's sentence, imposed by state District Judge Erwin Earnst, was severe because of his previous offences.

They include a 1992 conviction for aggravated assault, a 1991 conviction for transferring a controlled substance, and forgery and burglary convictions in the 1980s.

Ferguson testified during his trial that Pope and another officer had physically assaulted him. The Texas Department of Criminal Justice provided a video during the trial, which didn't show an assault.

"The way the faeces was thrown on Pope did not indicate it was an accident," said Weeks. "Pope said that after (Ferguson) threw the faeces he said, 'I told you . . . that I would get you.' "

Weeks said typically defendants in similar cases plead guilty and receive a 10 to 15-year sentence.

She said Ferguson was offered a similar plea agreement, but he wanted to take his case to a jury.
