FDCH e-Media, Inc. For Immediate Release October 28, 2004 Levin, Kennedy Ask Rumsfeld About Missing Explosives in Iraq WASHINGTON - Sen. Carl Levin, D-Mich., and Sen. Ted Kennedy, D- Mass., today wrote a letter to Secretary of Defense Donald Rumsfeld regarding the 342 tons of explosives that have been reported missing from the Al-Qaqaa facility in Iraq. The Senators' letter follows: October 27, 2004 The Honorable Donald H. Rumsfeld Secretary of Defense The Pentagon Washington, DC 20301 Dear Secretary Rumsfeld: We are writing to inquire what specific policy guidance was provided to military commanders in Iraq before, during, and after the U.S. invasion to guarantee that known stockpiles of explosives and ammunition at the Al-Qaqaa facility and elsewhere in Iraq would be secured or destroyed. We are also seeking information as to how that policy has been implemented. Securing these materials should have been one of our highest priorities from the outset of the war. The disclosure that about 342 tons of high explosives have disappeared from the Al-Qaqaa facility is deeply and profoundly troubling, especially because the facility was so well known to the United States and the international community before the war. The materials at this site had been secured since 1991, when the International Atomic Energy Agency sealed the storage bunkers holding the HMX high explosives as part of the U.N. sanctions regime that required the dismantlement of Iraq`s nuclear program after the Gulf War. The IAEA reportedly visited the site for the last time in March 2003, before pulling out of the country, just before U.S. forces began the war. The IAEA was notified on October 10 by Iraqi authorities of the loss after April 9, 2003, through the theft and looting of the governmental installations due to lack of security, of high explosives at the Al-Qaqaa facility. David Kay, the former head of the Iraq Survey Group, said he saw the facility in May of 2003 and it was heavily looted at that time. Sometime between April and May, most of the stuff was carried off. The site was in total disarray, just like a lot of the Iraqi sites. In light of the fact that this facility and the presence of the powerful explosives were well known to the United States and the international community, it is unfathomable that the highest priority was not given to securing it, in order to prevent its loss to anti-American insurgents and terrorists. Unfortunately, the looting of lethal material is not isolated to the Al-Qaqaa facility. Last year, David Kay informed the Congress that approximately 130 known Iraqi Ammunition Storage Points existed in Iraq, some of which exceeded 50 square miles in size and held an estimated 600,000 tons of artillery shells, rockets, aviation bombs and other ammunition. Additional previously unknown ammunition and weapons sites continue to be discovered. At an October 6 hearing in the Senate Armed Services Committee, General McMenamin, Commander of the Iraq Survey Group, was asked if he could provide assurances that all these sites are tightly secured by U.S. forces so that no weapons could fall into the hands of insurgents. General McMenamin told the Committee, I cannot assure you. He said, On the larger ones, we have security forces, overhead imagery. There's an active program ongoing to destroy excess munitions around the country. On a regular basis, we're destroying excess captured munitions to keep them out of the hands of the insurgency. As the Iraqi forces come online in their security efforts, they'll be able to take over and protect those assets to prevent them from falling into the wrong hands. It is essential for Congress and the country to know how high a priority this security was given, what precise policy guidance was provided by the Department of Defense, and implemented by commanders in the field to secure all of these sites before, during, and after the invasion. We have tried to obtain information about the scope of this problem in the past, but we have never received a comprehensive response. We look forward to hearing from you now about this important issue. Sincerely, Edward M. Kennedy Carl Levin

WASHINGTON, D.C. U.S.A.
For Immediate Release October 28, 2004 SKELTON, HARMAN QUESTION DOD AND CIA ON MISSING WEAPONS CACHE WASHINGTON, DC - Today, Reps. Reps. Ike Skelton (D-MO), Ranking Member on the Committee on Armed Services, and Jane Harman (D-CA), Ranking Member on the House Permanent Select Committee on Intelligence sent the following letter to Secretary of Defense, Donald Rumsfeld and Director of Central Intelligence, Porter Goss: Dear Mr. Secretary and Director Goss: We seek answers to questions we have about recent press reports describing the disappearance of some 380 tons of high explosives from the al- Qaqaa Iraqi military facility. Obviously, the prospect of that much explosive material falling into the hands of Iraqi insurgents or others who would harm our troops and Iraqi citizens is cause for concern. What is more disturbing is the reporting that the United States government was informed about the location of the material by international inspectors and that our forces may have had the chance to search and secure the facility in time to prevent the theft of this material. Accordingly, please answer the following questions: * Were the Department of Defense, U.S. military forces, or the Central Intelligence Agency aware before the March 2003 military invasion of Iraq that highly explosive materials such as HMX and RDX and/or ammunition were cached at the al-Qaqaa facility? * Press reports indicated that 3rd Infantry Division troops fought with Iraqi forces at the facility and then occupied the site. If this report is accurate, what effort, if any, was made by U.S. forces to secure the al-Qaqaa facility? What was done to inspect and inventory the contents of the facility, and when was such action taken? * At what point in time did our forces in Iraq learn that the al-Qaqaa facility had been looted? What effort, if any, did our military forces, the Iraq Survey Group, or the Coalition Provisional Authority undertake to locate and retrieve the missing explosives? To what extent were they successful? * Weapons experts have noted that the removal of so many tons of explosives would pose significant logistical challenges. By some accounts, dozens of trucks would have been needed to carry off this much material. To what extent, if any, was increased vehicular traffic noted that, in retrospect, might be consistent with the removal of material from the facility? If such increased traffic was detected, what was done in response? * Is there any evidence that any bombings or IED attacks conducted in Iraq since March 2003 against American forces or Iraqis have employed these materials? * We have been told during past visits to Iraq that there are many weapons and ammunition storage sites throughout the country. Has any American official spoken with the International Atomic Energy Agency to ensure that there are no other such sites at which similarly dangerous explosive material might still be located and unsecured? * Have all other existing caches of highly explosive materials in Iraq been inventoried and secured by U.S. forces? We believe we must do everything in our power to protect our troops in Iraq. If we can locate any of these explosives and prevent their use against our forces now, we owe it to our men and women in uniform to do what we can. By the same token, if the theft of this material could have been prevented, then there may be valuable lessons to learn that could have application to some of the many other military storage sites in Iraq. Thank you for your prompt attention to this letter. We look forward to your reply in the very near future. Sincerely, Ike Skelton Jane Harman
